1. Acceptance of these Terms
By creating an account, purchasing or accessing a product, subscribing to an App Plan or other subscription, or otherwise using Tagular, you agree to these Terms of Service.
If you do not agree to these Terms, you must not use Tagular.
2. The Tagular store
Tagular is an online store providing access to apps and related digital services operated by Tagular.
Tagular is not a multi-seller marketplace. References to user-operated shops, independent sellers, marketplace payouts, affiliate commissions or the Tagular Pool do not form part of the current Tagular service.
3. Accounts
You are responsible for providing accurate account information and maintaining the security of your account credentials. You must not share passwords, verification codes or other authentication credentials in a way that compromises your account.
You are responsible for activity performed through your account unless applicable law provides otherwise. Contact Tagular promptly if you believe your account has been accessed without authorization.
You may not use another person's account without permission, impersonate another person or entity, or create accounts for fraudulent, abusive or deceptive purposes.
4. Apps and access options
Tagular offers apps and related digital services. Each app page describes its features and the access options currently offered.
A purchase or subscription grants only the access or licence described for the product. It does not transfer ownership of Tagular's underlying software, content or intellectual property unless expressly stated otherwise.
5. Apps and usage-based access
Tagular apps may be free or premium. Depending on the app, premium access may be offered as individual usage access, such as 1 Use or 3 Uses, a monthly or yearly subscription, or through an eligible App Plan. An app is not required to offer every access option.
Usage-based access is consumed according to the app's stated usage mechanism. Available uses, subscription access and other app entitlements are connected to the Tagular account used to obtain them.
Usage entitlements are separate from App Credits. Usage entitlements may be consumed by performing an app's applicable paid action. App Credits instead measure App Plan capacity and are not consumed each time an app is used.
Free-app availability and premium-app access options may change prospectively as Tagular develops. Changes do not remove access already required by an existing paid entitlement or mandatory law.
6. App Plans and App Credits
App Plans provide subscription access to eligible premium Tagular apps. App Plans with 5, 10, 15 or 20 App Credits provide the corresponding amount of active App Credit capacity. Full Access provides access to all premium apps that are currently eligible for App Plans without an App Credit capacity limit.
App Credits
Each eligible premium app may have an App Credit cost. Selecting an app uses that amount of your available App Credit capacity for as long as the app remains selected. Different apps may require different numbers of App Credits.
App Credits are a measure of subscription access capacity. They are not money, stored value, a payment instrument or a cash balance; they have no cash value and cannot be withdrawn, redeemed for cash or transferred between accounts. App Credits are not consumed through ordinary use of a selected app.
You may select any combination of eligible premium apps whose combined App Credit cost fits within your available capacity. Free apps do not use App Credits.
Extra App Credits
Where offered, you may add Extra App Credits to an active App Plan for $3 per additional App Credit per month. Extra App Credits are recurring subscription additions and increase the App Credit capacity of the associated App Plan while they remain active.
Reducing or cancelling Extra App Credits may be limited where the requested reduction would leave your currently selected apps using more App Credits than the resulting capacity. Cancellation or reduction affects future recurring access and billing according to the subscription status and the cancellation method provided by Tagular or its payment provider.
7-day app lock
When an app is selected for an App Plan, that app is locked into the plan for 7 days from the time of selection. After the lock expires, the app may be replaced with another eligible premium app. A newly selected replacement begins its own 7-day lock period.
Plan changes
If you upgrade to a plan with more App Credits, your available App Credit capacity increases according to the new plan and existing selected apps may remain selected. Existing app lock periods continue on their original schedule unless otherwise clearly disclosed before the change.
App Plan eligibility and the App Credit cost assigned to apps may change prospectively as Tagular develops. Tagular will not intentionally use such changes to remove paid access in a manner that conflicts with an active entitlement or mandatory consumer law.
7. Pricing and taxes
Prices displayed by Tagular are the prices applicable to the selected product, access option or subscription, subject to taxes or other amounts that must be charged under applicable law.
Where VAT or another tax applies, Tagular may display the applicable tax as part of the price information or checkout. The final amount presented before payment is the amount applicable to that transaction.
Tagular may change prices prospectively. Price changes do not retroactively rewrite completed purchases. Changes to recurring subscription prices will be handled in accordance with applicable law and any notice requirements.
8. Payments and Stripe
Tagular uses third-party payment infrastructure, including Stripe where applicable, to process customer payments and recurring subscriptions.
Payment processing, verification, authorization, payment-method availability and related services may be subject to the payment provider's own terms and technical requirements.
Do not send Tagular full card numbers, card security codes or other sensitive payment credentials by email or support messages.
9. Purchases and digital access
A completed purchase grants the access or entitlement described for the selected product or access option. Access may consist of app usage, account-based app access, a subscription or another stated app entitlement.
Purchases and entitlements are connected to the Tagular account used for the transaction. You are responsible for purchasing through the correct account and maintaining access to it.
If payment succeeds but the expected entitlement is missing, contact Tagular rather than repeatedly purchasing the same item while the original transaction is being investigated.
10. Refunds, withdrawal rights and mandatory consumer rights
Except where Tagular states otherwise or applicable law requires a remedy, completed digital purchases are generally treated as final once the relevant digital content, app access, usage entitlement or service has been supplied or made available.
Nothing in these Terms removes or limits mandatory consumer rights that cannot legally be waived. Where applicable law gives you a right to cancellation, refund, repair, replacement, price reduction or another remedy, that right continues to apply.
Duplicate, incorrect or failed transactions
If you believe you were charged more than once, charged incorrectly, or payment completed without the expected entitlement being recorded, contact Tagular so the transaction can be investigated and corrected where appropriate.
11. Subscriptions and recurring billing
Monthly and yearly app subscriptions, App Plans and Extra App Credits are recurring services where identified as such before checkout. The applicable price and billing interval are shown before the subscription or recurring addition is started.
A subscription or recurring Extra App Credit addition may continue to renew until cancelled or reduced through the method made available by Tagular or its payment provider. Cancellation normally stops future renewals and does not automatically refund amounts already charged, except where required by law.
Access connected to a cancelled subscription may continue until the end of the paid billing period, depending on the subscription status and applicable payment arrangement.
12. Prohibited use
You may not use Tagular to:
- Commit fraud, deception, theft or other unlawful activity.
- Infringe copyright, trademark, privacy or other third-party rights.
- Distribute malware, malicious code or intentionally harmful software.
- Manipulate purchases, subscriptions, App Plan selections, usage entitlements, reviews or access systems.
- Attempt unauthorized access to Tagular, another account, private data or infrastructure.
- Interfere with platform security, stability or normal operation.
- Use automated activity in a way that materially abuses or overloads the service.
Tagular may investigate suspected abuse and may restrict relevant accounts, transactions, entitlements or access while doing so.
13. Intellectual property
Tagular's software, branding, logos, interface elements, apps and platform materials are protected by applicable intellectual-property laws and may not be copied, reproduced or represented as your own except where Tagular expressly permits it.
Purchasing or subscribing to a product does not transfer ownership of its underlying intellectual property unless expressly stated otherwise.
If you believe content on Tagular infringes your rights, use the infringement-report process described in the Tagular Intellectual Property Policy where available, or contact Tagular with sufficient information to identify the material and explain the claimed infringement.
14. Third-party services
Tagular may integrate with or depend on third-party services for payment processing, hosting, storage, APIs, email, infrastructure, analytics or other functionality.
Third-party services may operate under their own terms and privacy policies. Tagular is not responsible for independent services to the extent their operation is outside Tagular's control, subject to any responsibility that cannot lawfully be excluded.
15. Platform availability and changes
Tagular may add, change, suspend or discontinue features as the service develops. We do not guarantee uninterrupted availability or that every feature will always be free from errors.
Maintenance, security events, third-party outages, technical failures or other circumstances may temporarily affect access to Tagular or particular products. Existing paid rights remain subject to applicable law and the terms of the relevant entitlement.
16. Disclaimers and limitation of liability
To the fullest extent permitted by applicable law, Tagular is provided on an “as available” basis. Tagular does not guarantee that every product or app will meet every user's expectations or remain uninterrupted or free from defects.
To the fullest extent permitted by applicable law, Tagular will not be liable for indirect, incidental, special or consequential losses arising from use of the service where such liability may lawfully be excluded or limited.
Nothing in these Terms excludes liability or legal rights that cannot be excluded under applicable law.
17. Suspension and termination
Tagular may restrict, suspend or terminate access where reasonably necessary because of serious or repeated violations of these Terms, fraud, security risks, unlawful activity, payment abuse or harm to the integrity of the service.
Where appropriate, Tagular may restrict a particular product, app, entitlement or feature rather than the entire account.
Termination does not automatically erase obligations or records arising from transactions that occurred before the action was taken.
18. Changes to these Terms
Tagular may update these Terms as the store, products, subscription models, legal requirements or available features change.
The effective date displayed at the top of this page identifies the current version. Where required, material changes may also be communicated through Tagular or another appropriate method.
Where Tagular requires explicit acceptance of a new Terms version, the service may require that acceptance before relevant account activity can continue. Tagular may record the user, document version, time and technical information associated with that acceptance.
19. Operator, governing law and mandatory consumer rights
Tagular is the public-facing brand and service name used by Albert Fladby. At the effective date of these Terms, Tagular is operated by Albert Fladby in Norway and is not presented as a separately incorporated legal entity.
These Terms and the operation of Tagular are governed by Norwegian law, subject to mandatory rules that apply to a particular user or transaction.
If you are a consumer, nothing in these Terms is intended to deprive you of mandatory consumer protections that apply to you and cannot legally be waived, including mandatory protections that may apply because of the country in which you live.
The parties should first attempt to resolve disputes directly and in good faith. Any dispute that cannot be resolved informally may be brought before the competent courts or dispute-resolution bodies available under applicable law.
No organisation number is stated because Tagular is not currently operated through a registered Norwegian enterprise with an organisation number. If the business is registered later, these Terms may be updated accordingly.
